Terms and Conditions

1. About Whazii

Whazii ("we", "us", "our") operates the website whazii.com and provides a WhatsApp marketing platform that enables restaurants, takeaways, and local businesses based in the United Kingdom to send promotional campaigns to their customers via WhatsApp.

By accessing whazii.com or using any of our services, you agree to be bound by these Terms. If you do not agree, you must not use our services.

2. Eligibility

Our services are intended for business use only. By using Whazii, you confirm that:

  • You are at least 18 years of age.
  • You are using the platform on behalf of a legitimate business operating in the United Kingdom.
  • You have the legal authority to enter into this agreement on behalf of that business.
  • Your use of Whazii will comply with all applicable UK laws and regulations.

3. Accounts and Registration

To use Whazii you must register for an account. You agree to provide accurate information, keep login credentials confidential, and notify us immediately at hello@whazii.com if you suspect unauthorised use of your account. We may suspend or terminate accounts used fraudulently or in violation of these Terms.

4. Subscription Plans and Payments

Whazii offers Starter, Managed, and Direct Ordering plans. Plan features are described on our Pricing page and may be updated from time to time.

Subscription fees are billed in advance monthly and processed securely via Stripe. By providing payment details, you authorise Whazii to charge the applicable fees to your chosen payment method.

Where a free trial is offered, it will be clearly stated on our website. At the end of the trial, your account will move to the selected paid plan unless you cancel before the trial ends.

Subscription fees are non-refundable except where required by law. If you believe you have been charged in error, contact hello@whazii.com within 14 days of the charge.

We may change pricing at any time and will give at least 30 days' notice of any price increase by email.

5. WhatsApp Messaging - Your Responsibilities

Whazii facilitates WhatsApp messages on your behalf. You are responsible for message content and for ensuring:

  • You have valid, explicit opt-in consent from every recipient before sending marketing messages.
  • Your campaigns comply with WhatsApp's Business Policy and Commerce Policy.
  • Your messages comply with UK PECR and UK GDPR.
  • You maintain a clear and easy opt-out mechanism for all recipients.
  • You do not send spam, misleading content, or messages that harass, abuse, or harm recipients.

Whazii reviews campaigns before sending where described on our website, but this does not remove your legal obligations as data controller for your customer list.

6. Prohibited Use

You must not use Whazii to send spam, impersonate others, transmit unlawful or infringing content, reverse engineer the platform, attempt unauthorised access, or use the service in any way that could damage or impair our infrastructure.

7. Intellectual Property

All content, software, trademarks, logos, and materials on whazii.com are owned by or licensed to Whazii and protected by UK intellectual property law. You retain ownership of campaign copy and customer data uploaded to the platform, and grant Whazii a limited licence to use it solely to provide the service.

8. Data and Privacy

Our collection and use of personal data is governed by our Privacy Policy. As a business using Whazii to message customers, you act as data controller for your customers' personal data and Whazii acts as your data processor.

9. Disclaimer of Warranties

Whazii is provided on an as-is and as-available basis. We do not guarantee uninterrupted or error-free service or successful message delivery. WhatsApp's own platform availability is outside our control.

10. Limitation of Liability

To the maximum extent permitted by UK law, Whazii's total liability for claims relating to these Terms or services shall not exceed the total fees you paid in the three months before the event giving rise to the claim. Nothing excludes liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded under UK law.

11. Termination

You may cancel your subscription at any time via account settings or by emailing hello@whazii.com. We may suspend or terminate access if you breach these Terms, if required by law, or if we discontinue the service.

12. Governing Law

These Terms are governed by the laws of England and Wales. Disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

13. Changes to These Terms

We may update these Terms from time to time and will notify you by email or website notice at least 14 days before material changes take effect. Continued use after that date constitutes acceptance.
